Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Kitestring (“Kitestring,” “we,” “us”) governing your use of the Kitestring application and website at kitestring.app (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business, and “you” refers to it.

1. What the Service does

Kitestring helps sellers advertise their products. When you connect your accounts, the Service syncs products from your Shopify or Etsy store, drafts advertising copy (including with artificial intelligence), and creates and manages advertising campaigns in your Meta (Facebook/Instagram) ad account on your behalf, including suggesting or making changes such as pausing campaigns or adjusting budgets according to settings you choose.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for business use.

3. Your account

You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us at hello@kitestring.app if you suspect unauthorized access. You must provide accurate information and keep it current.

4. Third-party platforms

The Service works by connecting to accounts you hold with third parties — including Meta, Shopify, Etsy, Google, and Apple. Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them, including Meta’s Advertising Standards. Kitestring is not affiliated with, endorsed by, or sponsored by any of these companies. By connecting an account, you authorize Kitestring to access and act on that account (for example, reading your product catalog or creating ad campaigns) to the extent of the permissions you grant. You can revoke access at any time by disconnecting the account in Settings or from the third-party platform directly. If a platform changes or restricts its APIs, parts of the Service may stop working; we are not responsible for third-party platform availability, decisions, or actions (including ad rejections, account reviews, or suspensions).

5. Advertising spend

Kitestring never collects, holds, or bills your advertising budget. All ad spend is charged by Meta directly to the payment method on your Meta ad account, under your agreement with Meta. Budgets, spend caps, and pause rules you set in Kitestring are instructions we transmit to Meta on your behalf. We work to apply them promptly and accurately, but delivery, pacing, and billing are controlled by Meta, and synchronization delays, API failures, or platform behavior can cause actual spend to differ from your settings. You are responsible for all charges incurred on your ad accounts, and for monitoring your spend. We recommend also setting spending limits directly in your Meta ad account.

6. AI-generated content

The Service uses artificial intelligence to draft advertising copy and recommendations from your product information. AI output can be inaccurate, incomplete, or unsuitable. You review and approve all ad content before it is published, and you are solely responsible for the content of ads run from your accounts, including its accuracy, legality, and compliance with platform policies. Recommendations (for example, budget suggestions) are informational, not professional advice.

7. No performance guarantees

Advertising results depend on factors outside our control — your products, pricing, market conditions, and platform algorithms. We do not promise any particular outcome, including sales, revenue, reach, clicks, or return on ad spend. Metrics shown in the Service are sourced from third-party platforms and may be delayed, estimated, or revised.

8. Your content and our license

You retain all rights to your product listings, images, and other content. You grant Kitestring a limited, non-exclusive license to access, store, process, and transmit that content solely to operate and improve the Service — for example, sending product details to our AI provider to draft copy, or uploading a product image to Meta as ad creative at your direction. You represent that you have the rights to the content you connect and that our use of it as described will not infringe anyone’s rights.

9. Kitestring’s property

The Service — including its software, design, and branding — is owned by Kitestring and protected by law. We grant you a limited, non-transferable, revocable right to use the Service for your business. You may not copy, modify, resell, reverse engineer, scrape, or interfere with the Service, or use it to build a competing product.

10. Acceptable use

You agree not to use the Service to:

• advertise products or content that is unlawful, deceptive, or prohibited by the advertising platform;
• infringe intellectual property or privacy rights;
• transmit malware, probe or disrupt our systems, or access data that isn’t yours;
• misrepresent your identity or your relationship to a store or ad account.

11. Fees

The Service is currently offered free of charge. We may introduce paid plans in the future; if we do, we will give you at least 30 days’ notice and the choice to accept the pricing or stop using the Service before being charged. (Ad spend billed by Meta, described in Section 5, is separate and always yours.)

12. Termination

You may stop using the Service and request account deletion at any time by emailing hello@kitestring.app. We may suspend or terminate your access if you violate these Terms, if required by a platform partner or law, or if we discontinue the Service (with reasonable notice where practicable). Termination does not automatically stop campaigns already running in your Meta ad account — pause them in Kitestring or in Meta Ads Manager before you leave. Sections 5–9 and 13–16 survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, KITESTRING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT OR THIRD-PARTY DATA WILL BE ACCURATE.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) KITESTRING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; (b) KITESTRING’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID KITESTRING IN THE TWELVE MONTHS BEFORE THE CLAIM. FOR CLARITY, ADVERTISING SPEND BILLED BY META IS NOT AN AMOUNT PAID TO KITESTRING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You will defend and indemnify Kitestring against claims, damages, and costs (including reasonable attorneys’ fees) arising from your products or ad content, your violation of these Terms or of a third-party platform’s policies, or your violation of law or third-party rights.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at hello@kitestring.app and give us 30 days to try to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. Either party may instead bring an individual claim in small-claims court.

17. Changes to these Terms

We may update these Terms as the Service evolves. If a change is material, we will notify you (for example, by email or an in-app notice) at least 14 days before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
